General Terms and Conditions

Brews and Tales Amsterdam Craft Beer Tours

1.     Definitions:

Guide: the person conducting the Walking Tour on behalf of B&T (as defined hereinbelow).

Participant: the participant of the walking tours organised and provided by B&T.

Parties: B&T and Participant will be jointly referred to as Parties.

Walking Tour(s): specialised guided walking tour(s) through cities centers.

Brews and Tales Craft Beer Tours:  organizer of specialised walking tours, having its registered place of business at Van Spilbergenstraat 150-3, 1057RP Amsterdam, The Netherlands, registered with the Chamber of Commerce of Amsterdam under number 61278556, hereinafter referred to as B&T.

 

2.     General

2.1.  These General Terms and Conditions and the agreement between the Participant and B&T is governed by the laws of the Netherlands, and parties submit to the exclusive jurisdiction of the authorised courts of Amsterdam with respect to any dispute arising out of the delivery of the Services or the performance of B&T or the Participant.

2.2.  These General Terms and Conditions will apply to all bookings with and services of B&T.

2.3.  As the Walking Tour includes alcohol and some explicit content, the Participant must be at least 18 years old on the scheduled date of the Walking Tour and B&T reserves the right to request proof of age before the start of the Walking Tour.

2.4.  All Participants agree to read these General Terms and Conditions and by booking with B&T agree to be bound by them. Should a Participant book for a group it is their responsibility to pass on these General Terms and Conditions to the rest of the group.

2.5.  Each of the terms of these General Terms and Conditions are severable and distinct from one another and if at any time any term should become invalid, illegal or unenforceable, the validity, legality or enforceability of the other terms shall not in any way be affected or impaired.

2.6.  Nothing in these General Terms and Conditions shall confer on any third party any benefit or the right to enforce any provision of these terms.

 

3.     Services

3.1.  B&T organises and provides specialised guided walking tours for Participants through city centers.

3.2.  B&T reserves the right to adjust the content and route of the Walking Tour along the way should circumstances ask for that. Adjustments will be minor and will be in line with the ideology of the original tour.

 

4.     Booking Procedure

4.1.  The Participant can book a Walking Tour with B&T up to 6 months in advance through the website www.brewsandtales.com. Bookings can be made up to 24 hours before the start time of the tour.

4.2.  All quoted prices will be in Euros including VAT.

4.3.  The Participant will provide the following information: full name, nationality, phone number, e-mail address, address of accommodation in the Netherlands, number of Participants (if booking is for a group).

4.4.  After providing the information as described in section 4.3 hereinabove, the Participant will be directed to the payment page. Payments need to be done at the moment of booking by credit card, or any other electronic method of payment at the time available.

4.5.  As soon as payment has been received by B&T, the Participant will receive a booking confirmation by e-mail. This booking confirmation provides the information of the meeting point for the start of the tour. The Participant needs to bring the booking confirmation as proof of booking.

 

5.     Cancellation

5.1.  If B&T cannot provide the Walking Tour due to circumstances beyond B&T’s control, such as but not limited to adverse weather, B&T will offer an alternative date for the Walking Tour. Should the Participant not be available on the alternative date, B&T shall provide a full refund of the price.

5.2.  In the event that the Participant cancels their participation in the Walking tour 14 days before the start of the tour, a full refund will be provided. Should the Participant cancel within less than 14 days before the start of the tour, 50% refund will be provided. Should the Participant cancel within 7 days of the start of the Walking Tour or if the Participant does not show up at the agreed starting time of the Walking Tour (no-show) the Participant will not be eligible for a refund.

 

6.     Obligations of the Participant

6.1.  The Participant confirms that s/he will be at least 18 years old when participating in the Walking Tour.

6.2.  The Participant acknowledges that s/he will participate in a walking tour and confirms that s/he is able to walk a reasonable distance.

6.3.  As B&T provides Walking Tours through public areas, the Participant should be aware of the local rules and regulations applicable for pedestrians.

6.4.  The Participant is obliged to abide by all reasonable instructions of B&T.

6.5.  The Participant is obliged to refrain from:

6.5.1.        Consumption or transportation of recreational drugs;

6.5.2.       Displaying aggressive behaviour, harassing, threatening or acting in any other improper way towards the Guide, the persons interviewed during the Walking Tour or other Participants on the Walking Tour;

6.5.3.        In any way hindering B&T from performing its obligations.

 

7.     Liability disclaimer

7.1.  In consideration of his participation in the Walking Tour, the Participant will hereby release and discharge B&T, its officers, employees and board, jointly and severally from any and all actions, cases of actions, claims and demands for, upon or by reason of any damage, loss, or injury, which hereafter may be sustained by participating in the Walking Tour.

7.2.  This release extends and applies to, and also covers and includes, all unknown, unforeseen, unanticipated and unsuspected injuries, damages, loss and liability and the consequences thereof as well as those now disclosed and known to exist.

 

8.     Personal data and privacy

8.1.  Personal data provided by the Participant will be processed by B&T according to the EU 2016/679 regulations. Personal data will solely be used for the execution of the agreement between the Participant and B&T.

8.2.  Personal data will not be used for (direct) mailing unless the Participant gives his express approval. Personal data will not be shared with third parties.

8.3.  B&T reserves the right to take photographs and videos of the Walking Tours for commercial purposes, in which the Participant could be identifiable. Should the Participant wish B&T not to use a photograph or video, s/he should send an e-mail to hello@brewsandtales.com, specify the relevant photograph or video and B&T will refrain from using it.

 

9.     Complaints

9.1.  Complaints should be brought to the attention of the Guide immediately. The Guide will try to resolve the complaint immediately.

9.2.  Should a complaint not be solved to the satisfaction of the Participant, the Participant should send his/her complaint to B&T by e-mail as soon as possible, but at the latest within 14 days after participation in a Walking Tour. B&T will at its sole discretion decide if the complaint is valid and if and what compensation will be provided.

9.3.  In the event the complaint cannot be amicably be settled, the Participant may refer the dispute to the authorised courts of Amsterdam.
